1. Introduction

These Terms of Use (the “Terms of Service” or “Terms”) govern your use of Peeksy (the “Platform”). By accessing or using Peeksy, you agree to be bound by these Terms. If you do not agree, you must not use Peeksy.

2. Key things to know:

  • We may modify these Terms as permitted by law. We will notify you of material changes, and your continued use after the effective date means you accept the changes.
  • If you purchase a Subscription, it will automatically renew for the same period unless you cancel auto-renew before the next billing date. 
  • Your consumer rights may vary depending on where you live. Nothing in these Terms limits any non-excludable rights you have under applicable law.
  • If a dispute arises between you and us, you agree to notify us first and (if requested) participate in pre-suit mediation before bringing a claim.
  • All content uploaded is subject to AI moderation checks. Content that is prohibited will be automatically blocked. Content flagged as uncertain will undergo human moderation before publication.
3. Definitions

  • “Peeksy” means our website, services, apps, and tools accessed via peeksy.fans or other domains operated by us.

  • “we”, “our”, “us” means Beyond Infinity Holdings Pty Ltd (ABN [insert number]), registered in Queensland, Australia, the operator of Peeksy. 

  • “Business User” means a User using Peeksy for commercial purposes.

  • “Consumer” means any User who is not a Business User.

  • “Content” means any material uploaded to Peeksy by Users, including photos, videos, audio, livestreams, data, text, metadata, images, emojis, GIFs, memes, or other material.

  • “Creator” means a User who has set up a Creator account to post Content for Fans.

  • “Creator Earnings” means the share of Fan Payments payable to a Creator after our 10% platform fee and applicable taxes.

  • “Creator Interaction” means interactions granting access to Creator Content, including Subscriptions, pay-per-view Content, tips, and direct messages.

  • “Fan” means a User who pays for access to a Creator’s Content.

  • “Fan Payment” means payments made by Fans for Creator Interactions.

  • “GST/VAT” means Goods and Services Tax, or Value Added Tax. Sometimes referred to as Sales Tax. 

  • “Notice” means we contact you by message to your account, email, text, phone, or post.

  • “Subscription” means a Fan’s ongoing access to a Creator’s subscriber Content for recurring payments.

  • “User” means any person using Peeksy, including Creators and Fans.

4. Who we are and how to contact us

Peeksy is operated by Beyond Infinity Holdings Pty Ltd ABN [insert number], registered in Queensland, Australia.

5. Changes to Terms

We may update these Terms:

  1. To reflect legal, regulatory, or security requirements; or

  2. To improve how Peeksy operates or to protect Users, us, or third parties.

If changes are material, we will give you Notice. Continued use of Peeksy means you agree to the new Terms.

6. Using Peeksy

You must register to use Peeksy. You agree:

  • To provide accurate and complete information;

  • To keep your account secure and confidential;

  • To comply with all applicable laws;

  • To only create one account per person, unless authorised otherwise.

We may reject or suspend accounts that do not meet requirements.

7. Fan account requirements

  • You must be at least 18 years old;

  • You must be legally able to enter into a contract;

  • You must be legally allowed to view potential NSFW-material where you are located;

  • You must agree to pay for Creator Interactions where applicable.

8. Creator account requirements

In addition to Fan requirements, Creators must:

  • Complete ID and age verification (photo ID and selfie verification may be required);

  • Provide bank or payout details;

  • Provide tax information (ABN/TFN, GST where applicable);

  • Set pricing for Subscriptions if desired;

  • Upload Content in compliance with these Terms.

9. Content restrictions

Peeksy does not allow nudity or sexually explicit content of any kind. The Platform is not an adult service.

Permitted content includes modest lingerie and bikini imagery provided the intention is not sexual and the presentation complies with our Community Guidelines. Content that is suggestive, pornographic, or intended to arouse is prohibited.

By using Peeksy, you confirm you will not upload nudity or adult material and that you will comply with these standards at all times. We may remove any Content or suspend accounts that breach these rules.

10. Content rules

  • Content is not confidential. By uploading, you grant your Fans a licence to view it for personal use.

  • You remain responsible for all Content you upload. If you collaborate with others, you remain liable for compliance with these Terms.

  • You warrant that:

    1. You own or have rights to all Content you upload;

    2. All participants are at least 18 and gave informed, recorded consent;

    3. Your Content complies with these Terms and the law;

    4. You have licences or permissions for any third-party material used.

  • Prohibited Content includes:

    • Nudity or sexually explicit content of any kind;

    • Lingerie or bikini imagery presented in a sexual or pornographic manner;

    • Underage, non-consensual, or hidden recordings;

    • Bestiality, extreme violence, or otherwise illegal content;

    • Harassment, doxing, or hate speech;

    • Content filmed in public without consent of those appearing.

Peeksy employs AI-powered content moderation software to enforce these rules. Content identified as banned will be automatically denied at upload. If the software is uncertain, the content will be flagged and reviewed by human moderators before it is published. This means that all content must pass automated or manual checks before becoming visible on the Platform.

We may monitor, restrict, or remove Content that breaches these Terms, our Community Guidelines, or the law.

11. Fan Payments and Subscriptions

  • Creator Interactions are between the Fan and Creator. We facilitate but are not a party to those contracts.

  • Creators set prices (subject to our platform rules). All payments are processed in USD unless otherwise stated. Currency conversion fees may apply.

  • GST/VAT will be added where applicable.

  • Subscriptions automatically renew unless cancelled before the end of the current period.

  • Cancelling a Subscription means you retain access until the paid period ends.

  • You must not request chargebacks or refunds without valid reason. Bad faith requests may result in account suspension.

  • Wallet Credits (if available) are prepayments for Fan Payments. They are non-refundable unless required by law, do not accrue interest, and may be capped

12. Creator Payouts

  • We deduct a 10% platform fee from Fan Payments.

  • Creator Earnings are available for withdrawal once reflected in your balance and minimum thresholds are met.

  • Payouts are processed in USD unless otherwise stated. Banks or e-wallets may charge fees. We are not responsible for such charges.

  • If a Fan receives a refund or chargeback, we may deduct the relevant amount from your balance.

  • Except for direct transfers, we do not store payment details for your payout methods.

13. Taxes

  • Creators are responsible for their own tax obligations, including GST/VAT where required.

  • By using Peeksy, you confirm you will declare and pay all relevant taxes.

  • If you are non-compliant with tax obligations, we may suspend or close your account and withhold payouts.

14. Our rights

We may:

  • Suspend or remove Content or accounts that breach these Terms or law;

  • Review Content (including using automated systems);

  • Recommend Creators or Content to Users;

  • Cooperate with regulators and law enforcement;

  • Disclose account information in accordance with our Privacy Policy;

  • Use aggregated/anonymised usage data for lawful purposes.

15. Intellectual property

  • You retain ownership of your Content but grant Peeksy a worldwide, royalty-free licence to host, distribute, display, and use it to operate and/or promote the Platform.

  • You waive, to the extent permitted by law, moral rights in relation to necessary uses of Content.

  • We will never sell your Content to third parties. In the event of a sale of Peeksy or Beyond Infinity Holdings Pty Ltd or its assets, existing licences may be transferred.

16. Co-authored Content

  • You are responsible for all Content you upload.

  • You must tag Creators featured and obtain written consent from any non-Creators.

  • Consent can be withdrawn at any time, in which case Content may be removed.

17. Advertising and sponsored Content

  • Sponsored or promotional Content must comply with law and these Terms.

  • Sponsored Content must be clearly labelled (#ad, #sponsored, etc.).

  • Advertising restrictions: no tobacco, illegal drugs, prescription-only medicine, or unlawful gambling promotions.

  • Alcohol promotions must comply with local laws and not target minors.

  • AI-generated Content must be disclosed (#AI, #AIGenerated).

18. Account deletion

  • Fans: We will delete your account within a reasonable time after request. No further Subscriptions will be charged.

  • Creators: Accounts will stay open until all active Subscriptions end. We will pay outstanding Creator Earnings, then close the account. Deleting your account does not automatically delete Co-Authored Content posted by others.

  • After deletion, your data will be managed in line with our Privacy Policy.

19. Liability

Nothing in these Terms excludes or limits non-excludable rights under the Australian Consumer Law.

  • For Consumers: our liability is capped at AUD $250 per claim or the amount you paid us in the previous 12 months, whichever is greater, except where the ACL requires otherwise.

  • For Business Users: our liability is capped at AUD $5,000 or 100% of fees paid to us in the past 12 months, whichever is greater.

We are not responsible for:

  • Content posted by Users;

  • Third-party misuse of Content;

  • Loss from unauthorised access to your account;

  • Service disruptions caused by events outside our control.

20. General

  • If part of these Terms is unenforceable, the remainder still applies.

  • Our failure to enforce any part of these Terms is not a waiver.

  • These Terms are the full agreement between you and us regarding Peeksy.

  • You cannot transfer your rights under these Terms. We may transfer or assign ours.

21. Disputes

  • These Terms are governed by the laws of Queensland, Australia.

  • Disputes will be resolved in the courts of Brisbane, Queensland, unless mandatory local law requires otherwise. 

  • Claims must be brought within one year unless law prevents this. 

  • You agree to attempt mediation before litigation.
